We know that you care how your personal information is used and shared and we value your trust in us to handle it sensibly and cautiously. This Privacy Policy contains important information we are required to disclose by the General Data Protection Regulation (“GDPR”), including (i) the Controller of your personal information, (ii) how we collect and process your personal information through the ZeroDegrees Platform, (iii) your legal rights and (iv) the contact information of the Controller and the Data Protection Officer.

Where this Policy mentions “ZeroDegrees,” “we,” “us,” or “our,” it refers to ZeroDegrees of Separation Health, Unipessoal Lda (the “Controller”). Undefined terms in this Privacy Policy have the same definition as in our Terms of Service (“Terms”).

1. Controller of Personal Information

ZeroDegrees of Separation Health, Unipessoal Ltd. is the Controller of personal information collected and processed through the ZeroDegrees Platform at https://zerodegrees.health. To contact the Controller, see Section 9 of this policy.

2. Personal Information we collect

2.1 Information needed to use the ZeroDegrees Platform

We collect personal information about you when you use the ZeroDegrees Platform. Without it, we may not be able to provide the services you requested. Depending on the features you use, this information may include Account and Contact Information, such as your first name, last name and email address.

2.2 Information you choose to give us

You may choose to provide us with additional personal information. This information may include:

  • Profile Information for Customers, such as your personal description, status update, date of birth, gender, city, favourite activities, diet, education, social media accounts and public wishlists which are part of the profile page and may be publicly visible depending on the chosen visibility settings.
  • Health Information, such as your medical history, reproductive status and physical measurements (this information however remains private and is not published anywhere on the ZeroDegrees platform).
  • Listing Information, such as name, gender, business address, profile picture or logo, cover image, calendar availability and social media accounts.
  • Identity Verification, as permitted by applicable laws, such as images of your national Identity Card, Driving Licence or Passport (and visa where applicable). Please note we may scan, use, and store information contained in your ID to verify your identity.
  • Educational Degree(s) and Professional Credential Verification, as permitted by applicable laws, such as images of your degree(s) certificate(s) and professional credential or trade certificate (if applicable). Please note we may scan, use, and store information contained in your certificate(s) or credential.
  • Information About Others, such as when a ZeroDegrees member provides a payment method belonging to another person to complete a booking. By providing us with personal information about others, you certify that you have permission to provide that information to ZeroDegrees for the purposes described in this Privacy Policy, have shared this Privacy Policy with them, and they have read and understood that it applies to them.
  • Other Information, such as when you publish content in your timeline posts or group posts, leave comments on the site, submit a review for a service you booked or communicate with our customer support team or other Members.

2.3 Information Automatically Collected by Using the ZeroDegrees Platform

Certain personal information is automatically collected when you use the ZeroDegrees Platform. Depending on the features you use, this information may include:

  • Geo-location Information, such as precise or approximate location determined from your IP address or mobile device’s GPS depending on your device settings.
  • Usage Information, such as content you view, searches for Listings and bookings you have made.
  • Log Data and Device Information, such as details about how you’ve used the ZeroDegrees Platform (including if you clicked on links to third party applications), IP address, access dates and times, hardware and software information, device information, unique identifiers, crash data, cookie data, and the pages you’ve viewed or engaged with before or after using the ZeroDegrees Platform. We may collect this information even if you have not created a ZeroDegrees account or logged in.
  • Cookies, as described in our Cookie Policy.

2.4 Information Necessary for Use of Payment Services

When using the Payment Services, pursuant to the Payment Terms of Service, you may be providing certain personal information to a third-party payment processor. Depending on the type of payment processing you require, this information may include:

  • “Payin” Information, such as your full name and billing address, if you are an individual, or your corporate name, registered office, legal form and registration number, if you are a legal entity, as well as your email address, phone number, payment method used, payment date and time, payment amount, payment method expiration date, and other related transaction details, including your device IP address and ZeroDegrees order number. ​​
  • “Payout” Information, such as your Stripe email address, Stripe account ID, payout date and time, payout amount, and other related payment transaction details, including the ZeroDegrees order number associated with the booking that the payout refers to.

2.5 Information We Collect from Third Parties

We collect personal information from other sources, such as:

  • Third-Party Services. If you link, connect, or login to the ZeroDegrees Platform with a third party service (e.g. Google, Facebook), you direct that service to send us information such as your registration and profile information as controlled by the service or as authorized by you via your privacy settings at that service. If you have not uploaded a profile picture or connected via Google or Facebook, an anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. Your Gravatar will then be used as your profile picture and will be visible to the public.
  • Educational Degree(s), Professional Credential and Background Information. To the extent permitted by applicable laws and with your consent where required, we may obtain police or registered sex offender checks, educational degree(s), professional credential or trade certificate (if applicable) and other information about you and/or your background. We may use your information, including your full name and date of birth, to obtain such reports.
  • Referrals and Account Management. If you are referred to the ZeroDegrees Platform, the person that referred you may submit personal information about you such as your email address to facilitate account management and referrals to join as a member or to use our enterprise products.
  • Other Sources. To the extent permitted by applicable law, we may receive additional information about you, such as demographic data, or information to help detect fraud and safety issues from third party service providers and/or partners, and combine it with information we have about you. For example, we may receive background check results or fraud warnings from identity verification service providers for use in our fraud prevention and risk assessment efforts. We may receive information about you and your activities on and off the ZeroDegrees Platform, or about your experiences and interactions from our partners. We may receive health information, including but not limited to, health information related to contagious diseases.

3. How we use information we collect

3.1 Provide, Improve, and Develop the ZeroDegrees Platform

We process personal information for the purpose of providing, improving and developing the ZeroDegrees Platform given our legitimate interest in improving ZeroDegrees and our users’ experience with it, and where it is necessary for the adequate performance of the contract with you. In doing so, we may use personal information, described in Sections 2.1, 2.2, 2.3, 2.4 and 2.5 above, to:

  • enable you to access the ZeroDegrees Platform and make and receive payments,
  • enable you to communicate with other Members,
  • process your request,
  • perform analytics,
  • conduct research, debug and product development,
  • provide customer service and customer service training,
  • send you messages, updates, security alerts, and notifications,
  • personalize and customize your experience based on your interactions with the ZeroDegrees Platform, your search and booking history, your profile information and preferences, and other content you submit, and
  • enable your use of our enterprise products.

3.2 Create and Maintain a Trusted and Safer Environment

We process personal information for the purpose of creating and maintaining a trusted and safer environment given our legitimate interest in protecting ZeroDegrees and our users. In doing so, we may use personal information, described in Sections 2.1, 2.2, 2.3, 2.4 and 2.5 above, to:

  • detect and prevent fraud, spam, abuse, security and safety incidents, and other harmful activity,
  • study and combat discrimination consistent with our Non-Discrimination Policy,
  • conduct security investigations and risk assessments,
  • verify or authenticate information provided by you,
  • conduct checks against databases and other information sources, including background or police checks,
  • protect the health and well-being of our Members, Service Providers, and members of the public , such as when protecting against serious cross-border threats to health,
  • resolve disputes with our Members, including sharing information with your Service Providers about disputes related to services provided,
  • enforce our agreements with third parties,
  • enforce our Terms and all our other policies, and
  • in connection with the activities above, we may conduct profiling based on your profile information and interactions with the ZeroDegrees Platform and other content you submit to ZeroDegrees as well as information obtained from third parties. In limited cases, automated processes which analyse your account and activities on the ZeroDegrees platform as well as information in relation to activities on and off the ZeroDegrees platform that can be associated with you, could restrict or suspend access to the ZeroDegrees Platform if such processes detect activity that may pose a risk to ZeroDegrees, our community, or third parties. 3.3 Provide, Personalise, Measure, and Improve our Advertising and Marketing

We process personal information with your consent or based on our legitimate interest in undertaking marketing activities to offer you products or services that may be of interest to you. In doing so, we may use personal information, described in Sections 2.1, 2.2, 2.3, 2.4 and 2.5 above, to:

  • personalize, measure, and improve our advertising,
  • administer referral programs, rewards, or other promotional activities,
  • analyse characteristics and preferences to send you promotional messages, marketing, advertising, and other information we believe might be of interest to you as well as social media advertising through social media platforms, and
  • invite you to events and other relevant opportunities.

3.4 Provide Payment services

We process personal information for the purpose of providing Payment Services and ensuring the adequate performance of the contract with you. In doing so, we may use personal information described in Section 2.4 above to:

  • provide and improve Payment Services,
  • enable or authorise third parties to use the Payment Services,
  • detect and prevent money laundering, fraud, abuse, and security incidents,
  • conduct security investigations and risk assessments,
  • comply with legal obligations (such as anti-money laundering regulations),
  • enforce the Payment Terms.

3.5 Connect to Third-Party Accounts

We process personal information from linked third-party accounts, third party partners, and integrations to the extent necessary to ensure the adequate performance of our services. In doing so, we may use personal information, described in Sections 2.1, 2.3, 2.4 and 2.5 above, to:

  • publish some of the information on your ZeroDegrees public profile,
  • store, process and transmit it for fraud prevention and risk assessment purposes.

The publication and display of information from linked third-party accounts is subject to your settings on the ZeroDegrees Platform and your settings on the third-party service.

3.6 Analyse your Communications

We may review, scan, or analyse your communications on the ZeroDegrees Platform for the purpose of ensuring the adequate performance of our services and compliance with our Terms. In doing so, we may use personal information, described in Sections 2.1, 2.2, 2.3, 2.4 and 2.5 above, to:

  • provide customer support,
  • prevent fraud and promote safety,
  • conduct risk assessment,
  • improve the performance of our services.

We may use automated methods where reasonably possible. Occasionally we may need to manually review communications, such as for fraud investigations and customer support, or to assess and improve the functionality of these automated tools. We will not review, scan, or analyse your communications to send you third-party marketing messages and we will not sell analyses of these communications.

3.7 Comply with Law, Respond to Legal Requests and Protect our Rights

We may process personal information for the purposes of complying with applicable laws, responding to legal requests and protecting our rights. In doing so, we may use personal information, described in Sections 2.1, 2.2, 2.3, 2.4 and 2.5 above, to:

  • comply with our legal obligations,
  • respond to or comply with a valid legal request relating to a criminal investigation (such as a court order or subpoena),
  • respond to claims asserted against ZeroDegrees,
  • prevent a breach of the law,
  • facilitate the collection of taxes and prevent tax fraud,
  • enforce our agreements with Members, which include all our Terms and Policies,
  • protect the rights, property or personal safety of ZeroDegrees, its employees, its Members, or members of the public,
  • respond to or address any other activity that may expose us, you, or other users of our platform to legal or regulatory liability.

We may also be legally required to disclose Members’ information to competent authorities. See Section 5.5 of this Policy for more information.

4. How long we retain your data

We retain personal information consistent with applicable law and for as long as needed considering the purpose(s) for which it was obtained. The retention period is determined by criteria that include (i) the length of time you have an account with us or keep using the ZeroDegrees Platform, (ii) whether we are subject to a legal obligation to retain your personal information, for example, to keep records of your transactions (such as orders, bookings, subscriptions, refunds) for a certain period of time before we can delete them, and/or (iii) whether retention is advisable with regard to applicable statutes of limitations, litigation or regulatory investigations.

5. Sharing & Disclosure

Where you provide consent, we share your information as described at the time of consent, such as when authorizing a third-party application or website to access your ZeroDegrees account or when participating in promotional activities by ZeroDegrees or third parties.

Where permissible under applicable law, we may use certain information about you such as your email address and share it with social media platforms to generate leads, drive traffic to the ZeroDegrees platform, or otherwise promote our products and services.

5.2 Information You Publish on the ZeroDegrees Platform

Certain information you choose to share on the ZeroDegrees platform may be publicly visible to others, such as:

  • Your profile page, which includes your profile picture, cover photo, social networks links, public wishlists and other profile information you choose to make public according to its visibility settings.
  • Follower count, number of articles you have published and when you were last active may be visible on the member’s directory.
  • Comments, ratings or reviews.
  • Listing pages, which may include location, calendar availability, cancellation policy, price and additional information you choose to share.
  • Content you publish in your timeline posts or group posts, according to your activity visibility settings.

In contrast, certain information you share is kept private and is not published anywhere on our platform, such as:

  • Your year of birth remains private (only the day and month of your birthday may be visible).
  • Your professional credential details and images of your government issued ID (as permitted by applicable laws) remain private and serve only for conducting verification processes and issuing verification badges.
  • Your health information under the Research Studies section of your profile, which includes your medical history, reproductive status and physical measurements remains private and is not published anywhere on the ZeroDegrees platform and is not shared with any third parties.

We may display parts of your listings, articles or recipes on third-party sites, platforms, and apps to promote your services and drive traffic to your publications. Please note that information you share publicly on the ZeroDegrees Platform may be indexed through third-party search engines.

5.3 Information Automatically Published on the ZeroDegrees Platform

Certain profile information as well as certain aggregated demand and feedback information is automatically published on the ZeroDegrees platform and is publicly visible to others, such as:

  • Name, handle and member number are automatically published on customers’ profile page.
  • Unique page views are automatically published on article and recipe pages.
  • Total bookings are automatically published on service listing pages.
  • Total number of reviews and average ratings are automatically published in all listing, article and recipe pages.

5.4 Interactions between Members

We may need to share your information in order to facilitate interactions between Members. For example, when a Customer makes a booking or submits a refund request, certain information, including your profile page URL, name, profile picture, phone number, cancellation or refund history and other information you choose to submit, may be shared with the Service Provider.

5.5 Complying with Law, Responding to Legal Requests and Protecting our Rights

Where legally required or permissible according to applicable law, we may disclose Members’ information to law enforcement, tax authorities, governmental or public authorities, or authorized third parties. For example, we may disclose Members’ information to tax authorities for determination of proper compliance with tax obligations such as service providers’ individual tax obligations on bookings we facilitate through our platform and our own tax obligations on the respective fees we charge for providing that booking service.

Information about service providers and customers that may be disclosed is described in Sections 2.1, 2.2, 2.3, 2.4 and 2.5 above, and may include names, billing addresses, tax/business identification number(s), date of birth, contact information, transaction dates and amounts, gross and net booking amounts, and payout information, to the extent any of this information is known by ZeroDegrees.

We may notify Members about legal requests, except where such notification (i) is prohibited by applicable law or by court order we receive, (ii) may expose ZeroDegrees to a claim of obstruction of justice, (iii) may create a risk of injury or bodily harm to an individual or group, or (iv) may create or increase a risk of fraud upon or harm to ZeroDegrees or our Members.

5.6 Third-Parties & Integrations

We share personal information with third-parties which are not owned or controlled by ZeroDegrees. These third-parties help us deliver our services, including: (i) verifying your identity or authenticating your identification documents, (ii) checking information against public databases, (iii) conducting background or criminal record checks, (iv) preventing fraud and assessing risk, (v) developing, maintaining and debugging our products, (vi) allowing the provision of our services through third-party platforms and software tools (e.g. through the integration with our APIs), or (vii) providing customer service, advertising, or payment processing services.

Use of the services provided by these third-parties is subject to their respective privacy policies, such as Google Maps/Earth, Google Privacy Policy, Google Calendar, Facebook, Stripe Privacy Policy, Google Analytics, Gravatar.

5.7 Business Transfers

If ZeroDegrees undertakes or is involved in any merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer, or share some or all of our assets, including your information in connection with or in contemplation of such transaction (e.g., due diligence). In this event, we will notify you before your personal information is transferred and therefore becomes subject to a different privacy policy.

6. Your rights over your personal information

You can exercise any of the rights described in this section consistent with applicable law. We may ask you to verify your identity before taking further action on your request.

6.1 Managing Your Information

You are responsible for keeping your personal information up to date and you can review and update it through your Account settings. You have the right to ask us to correct inaccurate or incomplete personal information which you cannot update yourself within your ZeroDegrees account. To do so, please contact our Data Protection Officer by clicking here. If you connected your ZeroDegrees Account to a third-party service, like Facebook or Google, you can unlink from that service by going to your Account Settings and selecting Connected Accounts.

6.2 Data Access

You have the right to request a copy of the personal information we hold about you in a structured, commonly used, and machine-readable format.

To request a copy of the personal data we hold about you, please go to your Account Settings and select Privacy, then click on Request Data Export. We will process your request and send you an email when the file containing your personal information is ready for downloading. You can download it straight from the email or by logging in to your Account Settings, selecting Privacy and then clicking on the Download Personal Data button. Please note that for privacy and security reasons, this file will be automatically deleted 48 hours after your data export request was completed and you will need to submit a new request to export your personal data.

6.3 Data Portability

You have the right to request us to transmit the personal information we hold about you to another service provider, in a structured, commonly used, and machine-readable format, where this is technically feasible. To do so, please contact our Data Protection Officer by clicking here.

6.4 Data Erasure

You have the right to ask us to erase your personal information. Erasing your data will delete all of the content associated with it, including your listings, media and Zedos points. It will be completely irrecoverable.

Please note that the erasure of your personal information, as well as the termination or voluntary deletion of your account (as outlined in section 6.5 below) is subject to certain limitations and restrictions:

  • We may retain your personal information as necessary for our legitimate business interests, such as improving safety, detection and prevention of fraud and money laundering. For example, if we terminate a ZeroDegrees account for fraud or safety reasons, we may retain certain information to prevent that Member from opening a new ZeroDegrees account in the future.
  • We may retain and use your personal information to the extent necessary to comply with our legal obligations. For example, ZeroDegrees may keep your information for tax, legal reporting and auditing obligations.
  • Information you have shared with others (e.g., reviews, comments) will remain in our database and will continue to be publicly visible on the ZeroDegrees platform, even after your personal information is erased or your ZeroDegrees account is terminated or deleted. However, this information will be disassociated from personal identifiers and attribution of such information to you will no longer be possible.
  • We may retain residual copies of your personal information in our backup systems for a short period of time, until such time as a new backup is automatically made and the previous backup is automatically deleted. These backup copies exist to protect data from accidental or malicious loss and destruction.

To request the erasure of your personal data, please go to your Account Settings and select Privacy, then click on Request Data Erasure. We will process your request and send you an email when your personal information has been erased.

6.5 Account Deletion

You have the right to delete your account. Deleting your account will result in the deletion of all the content it has created as well as your personal information (except for certain information that we may retain, as outlined in section 6.4 above). The deletion of your ZeroDegrees account cannot be reversed and all its data will be completely irrecoverable. This means that we will no longer be able to provide our services to you and if you decide to use ZeroDegrees again in the future, you will need to set up a new account and start afresh. To delete your account, please go to your Account Settings and select Privacy, then click on Delete Account.

You have the right to withdraw your consent for the processing of your personal information at any time by changing your account settings or by contacting our Data Protection Officer specifying which consent you are withdrawing. Please note that withdrawing consent does not affect the lawfulness of any processing activities based on such consent before its withdrawal.

6.7 Opt-out from Marketing Communications

You have the right to opt-out from marketing communications which you have previously subscribed to. To change your marketing preferences, go to your Account Settings, select Marketing Preferences, and then click the unsubscribe button for the marketing campaign you wish to unsubscribe from.

Please note that we will continue to use your contact details to send you emails related to a service you have requested (e.g. booking confirmation emails, transactional emails). If you wish to stop all communications from ZeroDegrees (including service messages), you will need to delete your ZeroDegrees account (see section 6.5 above).

6.8 Restriction of Processing

You have the right to limit the ways in which we use your personal information, in particular where (i) you contest the accuracy of your personal information, (ii) you oppose the erasure of your personal information, (iii) we no longer need your personal information for processing purposes, but require it for the establishment, exercise, or defence of legal claims, or (iv) you have objected to processing pursuant to Section 6.9 (below) which is pending verification of whether your legitimate grounds override our own.

6.9 Objection to Processing

You have the right to object to the processing of your personal information (i) for direct marketing purposes (including sharing your data with third parties for marketing purposes) or (ii) for legitimate or public interest purposes. If you object to processing based on legitimate or public interests, we will no longer process your personal information unless we have legitimate grounds for such processing including, but not limited to, the establishment, exercise, or defence of legal claims.

You may exercise your right to object to the processing of your personal information by contacting our Data Protection Officer. For opting out of marketing communications, see section 6.7 above.

6.10 Non-user data subject rights

If you are a non-user, you can exercise any of your non-user data subject rights by contacting our Data Protection Officer. Please provide the following information to help us process your request:

  • Specify your country of residence
  • Include the subject “Privacy Data Subject Right Request”

Please note that before taking action on your request, ZeroDegrees may need to confirm your identity.

6.11 Lodging a Complaint

You have the right to lodge a complaint about our data processing activities. You may file a complaint with our Data Protection Officer by clicking here or with your local supervisory authority.

7. Security

We design our systems with your security and privacy in mind. While no organization can guarantee perfect security, we are continuously implementing and updating administrative, technical, and physical security measures to help protect your information against unauthorized access, alteration, loss or destruction.

  • We continuously train our staff to ensure the privacy and security of your personal data.
  • We work to protect the security of your personal information during transmission by using encryption protocols and software.
  • We follow the Payment Card Industry Data Security Standard (PCI DSS) when handling credit card data.
  • We maintain physical, electronic and procedural safeguards in connection with the collection, storage and disclosure of personal customer information. Our security procedures mean that we may ask you to verify your identity before we disclose personal information to you.

It is equally important for you to protect against unauthorised access to your ZeroDegrees account and to your computers, devices, and applications. We recommend using a unique password for your ZeroDegrees account that is not used for any other online account. If you are using a shared computer, make sure to sign off when you finish.

8. Changes to this privacy policy

We reserve the right to modify this Privacy Policy at any time in accordance with applicable law. If we do so, we will post the revised Privacy Policy and update the “Last Updated” date at the top. In case of material changes, we will also provide you with notice of the modification by email at least thirty (30) days before the effective date. If you disagree with the revised Privacy Policy, you can delete your Account. If you do not delete your Account before the date the revised Privacy Policy becomes effective, your continued access to or use of the ZeroDegrees Platform will be subject to the revised Privacy Policy.
